DESCRIPTION OF CASE
Plaintiff was injured when the elevator he was riding in jerked, descended rapidly and then came to a sudden stop between floors. The Defense disputed liability, arguing they had no prior notice that the elevator would malfunction.
INJURIES/DAMAGES
Plaintiff injured his left knee, left shoulder and lower back. Plaintiff underwent arthroscopic surgeries to his left shoulder and knee, and an outpatient low back procedure involving the decompression of 2 lumbar discs. Plaintiff alleged damages for lost earnings, medical expenses, pain and suffering and loss of enjoyment of life. The Defense disputed that the forces involved in the accident could have caused the injuries alleged, and argued that Plaintiff had made a full recovery from any injuries that he had suffered.
