The Plaintiff was a retired 57 year old teacher at the time of the accident.
DESCRIPTION OF CASE
The Plaintiff’s vehicle was struck in the rear. There was no discernible property damage to her vehicle. The Plaintiff refused EMS at the scene of the accident. The Plaintiff had a long standing history of neck and back problems dating back to her early childhood. She also had a back surgery prior to the within accident and a neck surgery was recommended prior to the within accident. The Plaintiff was actively receiving treatment for her neck and back prior to the within accident. The claim in this case was for exacerbation of her prior injuries. The Plaintiff underwent multiple neck and back surgeries after the within accident. The defense contended that such surgeries were in no way caused by the within accident. The case settled three weeks prior to jury selection.
