Accident Description
Plaintiff was working as livery driver at the time of the collision. Plaintiff was stopped at a red light on Bedford Avenue where it intersects with Putnam Avenue when – without warning – he was rear-ended by a truck. The truck driver claimed that he was stopped behind Plaintiff at the red light on Bedford Avenue when the light turned green and Plaintiff began to move and then stopped suddenly causing defendant to hit Plaintiff’s vehicle in the rear. The truck driver further claimed that plaintiff was on his cell phone and not paying attention while operating his vehicle. The defense also produced an independent witness who also claimed plaintiff was on his cell phone and not paying attention to the road.

Injuries/Damages
The Plaintiff sustained spinal disc herniations at the C3-C4 and C4-C5 levels with radiculopathy, which required an anterior cervical discectomy and fusion (ACDF surgery). Plaintiff claimed he would need future medical care and treatment for the injuries sustained in the accident.

The Defendants argued that the impact was minimal and that the herniated discs were pre-existing and not caused by the car accident. Further, defendants claimed that plaintiff had an excellent result from the cervical spine surgery and requires no additional treatment.
