Description of the Case
Plaintiff was driving her Ford Suburban vehicle in Queens on a Clearview Expressway Exit Ramp, intending to turn right onto Northern Boulevard. The Defendant truck was traveling in the same direction, and making the same right turn, but was positioned in the lane to the left of Plaintiff’s vehicle. As the vehicles turned right, they made contact with one another. Plaintiff claimed the truck improperly entered her lane, and the truck claimed that the Plaintiff improperly cut him off. Both sides retained accident reconstruction experts who disagreed about who was at fault.
Injuries
Plaintiff suffered a neck injury, with two herniated discs revealed by MRI study. She underwent a course of physical therapy and epidural steroid injections, and then ultimately a neck surgery consisting of anterior cervical discectomy with fusion at the C3/C4 level. Plaintiff returned to full time work after the incident, and had no claim for lost earnings. She claimed damages for past and future medical costs, and her pain and suffering.
