Plaintiff was 32 years old at the time of the accident, and was working as an electrician.

Description of the Case

Plaintiff was working as an electrician at a project at a large residential Hamptons property, which involved running communication wires from the property’s Main House to the Guest and Pool Houses. Plaintiff was standing on the third step of an A-Frame ladder, and using a hand-held electric drill to drill a hole into the foundation wall of the Guest House. His drill struck rebar and kicked, causing Plaintiff to lose his balance and causing the ladder to wobble. As a result, the drill struck Plaintiff in the face and he fell off the ladder to the floor below.

Injuries

Plaintiff suffered a laceration to his face that required sutures to close, and four fractured teeth that were repaired with dental surgery. Plaintiff also sustained neck, low back and shoulder injuries, which required physical therapy, injections, and ultimately a neck and right shoulder surgery. Plaintiff returned to work for two months immediately after the incident, and also had a history of two prior accidents that involved prior injuries to his head, face, neck and lower back.
