$1,300,000 AWARD FOR 70-YEAR-OLD PEDESTRIAN WHO SUFFERED LEG FRACTURES AFTER BEING STRUCK BY A VEHICLE

PLAINTIFF

At the time of the accident, Plaintiff was a 68 year old retired female.

LIABILITY

At the time of the happening of the accident, Plaintiff was a pedestrian crossing the street at the intersection of 163rd Street and Northern Boulevard in Queens County. As Plaintiff was crossing the street, with a walk signal in her favor, Defendant made a right hand turn and struck Plaintiff in the crosswalk. Defendant argued that Plaintiff walked out in front of his vehicle, without looking for oncoming traffic, and that he had already begun to make the turn when Plaintiff walked into the roadway.

DAMAGES

As a result of the accident, Plaintiff suffered fractures to her left distal tibia and fibula. She was admitted to the hospital where she underwent surgery to her left leg. Following surgery she underwent inpatient rehabilitation and was subsequently discharged.

Despite undergoing surgery, Plaintiff continued to suffer pain to her left lower extremity. As a result of her ongoing pain, she required a cane for ambulation, was unable to ambulate for extensive periods of time and required some assistance with activities requiring prolonged walking or standing.
