$2,300,000 Settlement for Injuries Caused by Bathroom Ceiling Collapse

A 27-year-old man was injured when a portion of his bathroom ceiling fell down. The collapsed ceiling was caused by a water leak from the upstairs apartment. As a result of the incident, the Plaintiff sustained serious injuries requiring neck surgery. Represented by Partners Jeffrey A. Block and S. Joseph Donahue, he received a $2.3 million settlement.

Block O’Toole & Murphy trial lawyers Jeffrey A. Block and S. Joseph Donahue recently persuaded an insurance company to pay $2,300,000 to settle a claim for a 27 year-old Brooklyn man who was injured when the ceiling of his bathroom collapsed. The ceiling collapsed after the landlord negligently failed to fix the bathroom ceiling that had sustained water damage due to a leak in an upstairs apartment.

INJURIES SUSTAINED
The young man suffered a neck injury that resulted in the need for a neck surgery, a one level cervical discectomy and fusion. While the man had suffered a neck injury three years earlier in a motor vehicle accident, Block and Donahue argued that the ceiling collapse caused the pre-existing herniation in his neck to worsen, thus requiring surgical intervention. The surgery was successful and the Plaintiff was able to resume many of his normal activities, including seeking employment.

The settlement came as firm partners Block and Donahue were about to begin jury selection in Brooklyn Supreme Court.
