Tragic Long Island Collision Results In $3,000,000 Wrongful Death Recovery
This tragic accident took place at the intersection of County Road 83 (hereinafter referred to as “CR 83”) and Canal Road, in the town of Brookhaven. The intersection is controlled by a traffic light. At the time of the accident the Plaintiff was traveling Northbound on CR 83, in the right hand land. The Defendant was traveling Southbound on CR 83. At the intersection of CR 83 and Canal Road, the Defendant entered the left hand turn lane in order to make a left hand turn from CR 83 onto Canal Road. The Defendant proceeded to make a left hand turn onto Canal Road, crossing over the CR 83 Northbound lanes of traffic. While attempting to turn onto Canal Road, the Defendant’s car collided with the Plaintiff’s vehicle.
Block O’Toole & Murphy’s trial lawyers conducted an extensive investigation, revealing, among other things, several eyewitnesses. These witnesses attested that the Plaintiff had the right of way with a green traffic light. Defendants argued that the defendant had a green turn signal and that the Plaintiff was traveling at an excessive rate of speed, a fact confirmed by a Suffolk County Police investigation.
As a result of the accident, the Plaintiff suffered severe injuries and was removed from the scene by EMS and taken via Medevac helicopter to Stony Brook University Hospital, where he remained unconscious until he passed away, approximately eleven (11) hours later. The Plaintiff left a loving wife and two adult children.
The Plaintiff was also a successful entrepreneur and a claim for loss of income was also asserted.
This matter was resolved for $3,000,000.00 after a mediation was held prior to trial. The case was handled by Jeffrey A. Block of Block O’Toole & Murphy.
